I sold an item which was listed as for parts not working with accessories . Upon receipt of the item the buyer says the parts he wanted from the device as a replacement for his current decice are damaged, therefore the item is not as described. I have a non return policy on the private account, the listing had the words " no returns accepted- do not bid if you do not agree" on an auction listing for an item under £10.
Uk distance selling regs do not apply because the item is under £42 and it was an auction.
EBay say the return request is valid , what?
The described item and all described accessories were sent and I assume received. I didn't send a pair of socks or an empty packet of sugar.
How is it not as described ? I do not understand please explain

You are not buying an item to be repaired, that category does not exist. You are buying an item which is damaged as it does not work, that is the category.
The outside of the item will tell you how old it is, and there are probably many parts inside which have value to the correct person .
The mistake is yours, imo.

I cannot prove that I did not send a pair of socks.
However the shipping weight would and did match the item, and the buyer attached photos of the received item.

I agree, sellers mistake.
but only because of the as new. Any other scenario if it's in the not working category, it's not working, damaged , broken

Was in the not working category,
sold in that category, eBay refunded anyway.

I honestly think that listing in the 'for parts/not working' category is a real hiding to nothing.
Buyers hoping to get a bargain will purchase the item and then return it under some spurious not as described reason when they find that they can't repair it and re-sell it at a profit, or return the item once they've cannibalised it for parts or the parts they want can't be used.

Infuriating. Especially the negative rating. Sellers are sitting ducks for this sort of stuff.

I have just had the same problem. Listed an item as "for parts or repair" re-iterated the item didnt work in the description. The buyer clearly thought he could fix the item but then found he couldn't so initiated a return , which ebay found in his favour. I think ebay should remove the condition "for parts or repair" . It is giving unscrupulous buyers the opportunity to rip off honest sellers. The buyer then listed the item as working.!!

As you put that in the listing, if they could not repair it then it's not as described.

I suppose you are right however , I thought i had honestly listed the item as not working , if I bought an item marked for spares or repair , I wouldnt expect to be able to return it. I feel the buyer is abusing the returns system. I shall put it down to experience and thankfully its the first time on over 20 years of selling on ebay.
