i I have a question. I sold the item and the feedback left by the buyer is concerning. The buyer uses the fright service and they admitted. I wonder in the case if they claim they used 'en empty package' (they did it in the past seeing feedback) where do I stand with my rights ? thanks

Whatever is the "fright" service as it relates to eBay?
If you have sold an item and it's been paid for then you should despatch [tracked of course].
You could cancel but it is then likely that he will leave negative feedback

If they use a freight forwarding service they will forfeit their Money Back Guarantee protection. However, they could still open a case and it would be up to you to convince eBay they had used a freight forwarding service and ultimately to point eBay's own policy out to them:
If the feedback they have left for others is peppered with negs claiming empty boxes, items not arriving etc. the best thing to do is cancel the sale selecting "Problem with buyer's address". You would likely have to accept any negative feedback you received although you would be able to respond to it pointing out the facts.
