Hi. A buyer hasn't received their parcel and opened a case against me. Their delivery address is an Esso petrol station. Evri have marked the parcel as delivered and provided photographic proof of delivery, which the buyer has confirmed is at the correct location. The Esso Garage insist that the parcel is not there.
Ebay says that as the parcel has been delivered it is not my problem but the buyer says the Consumer Rights Act says that it is my responsibility to ensure he recieves the item.
Does anyone out there know what the legal position is and if I am still liable to refund even though the parcel was delivered to the address he gave?

Leave in the hands of EBay, you sent the item to approved location and there’s prove of delivery so your covered.

Also ensure the correct tracking number is input on the order record.

Was it sent as Click and Collect? Did the label have an eCP code on it?

They were a repeat buyer so I doubt they are trying a scam. They just want their parcel. I just don't see how I can still be liable if the Esso staff have lost their parcel. They chose to use a drop shop as their address and Evri have delivered it there for them. The picture shows the member of staff behind the counter receiving the parcel.

Then, as long as you used an Ebay label with the printed address on it with th eCP code, call CS. Ask to be connected to the C&C department and explain the issue.
You will be covered and your buyer should be also.

Just to add to the good advice you have already been given, the Consumer Rights Act 2015 only applies to Business Sellers.
