Hiya guys, sold a classic toy, a 40 year old MB Games bigfoot monster truck, buyer gave it to his grand childen at christmas to play with, they broke it. now he wants a refund. ebay said hes entitled, under seller guarantee.
buyer is known to be an evasisve and bad seller

Your listing seem to imply you are running a business.
If so you are listing on eBay as a private seller, so I would not be able to help in this matter

You learnt the hard way as you listed it under a buisness account then the buyer is entitled to a refund.

eBay have a MBG policy which means regardless of private or business account, buyers can return an item for not as described or doesn't match description/photos. Even if it's a private account with no returns accepted.
Op is indeed doing business selling though on a private account so most here will abstain from helping them continue to trade illegally.

Sorry, but that is inaccurate advice.
There are many examples of sellers on here who say they don't accept returns so the buyer damages the item and then opens a Not As Described case which eBay almost always approves and forces the seller to refund

That's awful: Bad eBay. A new plastic toy should be fit for purpose (children's play) and not break within days but surely a "classic" toy is obsolete, possibly not compliant with modern safety standards and shouldn't be given to children, and is sold as a "collector's piece" to be displayed in a museum or cabinet or on a shelf.

Ask him for photos of the damage and what they were doing. Ask him to send it back. He might want to keep it. If not, it'll cost you money but will inconvenience him. Leave good feedback for him but follow up with what happened.

Ah, that won't be acceptable. I thought that you might have a message from the seller actually saying that he gave it to his grandchildren and they played with it and broke it. That would've given you a small leg to stand on.
You will need to accept the return.

Looking at the items you've sold you certainly are, and now that sales are being reported to HMRC it's important to get your house in order.
As from 1st January your data is being collected and passed on to HMRC, see eBay's guidance page here:

As you are a business seller trading as a private seller in violation of eBay rules and the law your buyers have virtually unlimited rights.
