Evening all,

After some advice please! I sold an item to the value of £900, bought the shipping label via Ebay (Not via Simple Delivery) -

The buyer chose Evri as his preferred courier. I sent the item off, it was supposed to arrive yesterday, it didn't and the tracking was updated as 'Damaged' and that was it. No photos have been sent, and no other updates have gone onto Ebay/Evri system. I tried contacting Evri to battle with the automated system, supposed to have someone call or email me, no joy.

So, with no proof of damage, no photos, where do I stand in terms of compensation of the £900 if the item has, as i personally suspect, gone missing/stolen. I believe the item was covered for basic compensation but that's it. Which is what I'm probably going to get back.

I could have sworn i purchased the label through Simple Delivery which would have kept me covered for damage in transit, as well as the buyer.

Any advice appreciated!

How could anyone decline to insure the item to its value and then expect the carrier or packlink to pay out its value?

Its against the consumer rights act and unfair contract terms axt 1977, and is classed as a separate contract regardless. Any insurance taking out isn't to your benefit. You dont take out insurance on a pizza order, do you? No, but you still expect it to be delivered regardless. You've paid for that service.

Besides which if you were to read Packlinks terms of service, it states they are a search engine only to find a courier, and that when you select Evri, you enter a direct contract with them. Why would I pay Packlink for insurance when my contract is with Evri? If youre happy to pay sky high prices for insurance, then credit to you, those prices will continue to rise on the amount of parcels that go missing because people cant be arsed to do anything about it.

Can't go into full details due to legal stuff. But mediation went extremely well, and it is no longer going to court. Fault was admitted on certain things via their side.
