What the hell is eBay doing

So I just rejoined abay after ditching them because their customer service was terrible and the amount of counterfeit goods they allow. I couldn't believe they actually could get any worse. I sold my first item it was delivered but I've to wait a fortnight for payments. I've been told numerous pieces of conflicting info from eBay so I then asked the eBay rep for a subject access request over the phone and they refused. According to the gdpr laws in the UK if you make a verbal request they must comply. The manager point blank refused though. I suppose what I'm trying to say is I'm now going to report them and they'll get a fine. In no way shape or form does eBay policy supercede law. I think eBay would receive hugely impressive fines if the community were to the same.  The customer service is pathetic and the people on the phone couldn't care less. Enough is enough it's time the community fought back against these scoundrels and make them up their game.

Ebay are unregulated in the UK so reporting them would be fruitless.

There are many other posts about this ,see :- https://community.ebay.co.uk/t5/forums/searchpage/tab/message?advanced=false&allow_punctuation=false...

eBay are regulated by the FCA and the financial ombudsman will investigate
cases brought to it. These will also involve eBay paying a fee to the
ombudsman for the investigation and any compensation it deems appropriate
to the complainant.

EBay has a specific online process for Subject Access Requests.   Can I suggest you use it before a complaint?

Presumably you have fully registered for managed payments and read the payment hold guidance?

You'll find the law states I can make this request verbally to anyone
within the organisation and it should be deemed and treated as a formal
request. Not doing so can result in fines from the independent
commissioners office or ICO to yourself.

I've read the t's and c's penfold. eBay states they can hold your funds for
upto 14 days. The available funds are already removed. Where do eBay keep
these available funds? Are they in some mechanism that accrues interest? If
so is it in eBay's profit interest to hold them for longer than required to
gain more cash from sellers.

Actually they say typically for 14 days but may be longer.

What the hell is eBay doing

The eBay shill pops up yet again.

Ok Penfield,

How do we recognise a subject access request (SAR)?

An individual can make a SAR verbally or in writing, including on social
media. A request is valid if it is clear that the individual is asking for
their own personal data. An individual does not need to use a specific form
of words, refer to legislation or direct the request to a specific contact.

An individual may ask a third party (eg a relative, friend or solicitor) to
make a SAR on their behalf. You may also receive a SAR made on behalf of an
individual through an online portal. Before responding, you need to be
satisfied that the third party making the request is entitled to act on
behalf of the individual. It is the third party’s responsibility to provide
evidence of their authority.

Does anyone know WHY they're unregulated?

Who SHOULD be regulating them do we think?

Is it really true to say they're unregulated when there's laws around having to refund buyers unequivocally if they choose to (and do) return items?

Regards

Certainly not yourself anniebun. No need for the capitals and over
exaggerated phrasing.

eBay are not like a normal shop. They're T's&C's prevent people from
exercising there statutory rights and make the refund process etc long
winded so they can hold onto your money for as long as possible.

That's an old post anniebun you sound like an eBay rep trying to get some
clout.

Prob best you go do some research and keep eating those buns Annie.

Wow. What a fool you are.

I'm not a rep, and would be very glad to be the one regulating them...
