Hi - I recently bought an item for £600 under a buy it now. The seller got in touch a few days later stating that the listing on ebay was in error as the item was no longer available. They stated that they couldn't cancel the sale, so could I which I did. They then stated that the money hasn't transferred to them (I suspect because they haven't marked the item as being dispatched) and so were unable to refund me. Is there a way to get ebay to release the payment back to me?
Thanks in advance!

Your seller is either new and doesn't know the rules, or are playing you, knowing full well, a buyer cannot initiate a cancellation.
If the money is not available in their Payment Summary, eBay use their back up source to make that refund, usually their bank account, so no excuse to make a refund now. Once the refund is made the payout is released to them. You can perhaps message them this sequence.
The easiest and quickest way here is for the seller to cancel the order citing our of stock, this will fully refund you.
If they carry on making excuses and do not refund, you will have to wait one day after the item's last estimated date for delivery, and proceed this way:
Go right of the item purchased, and from More Actions select.... I Have Not Received My Item.
If you are not fully refunded within 3 days, you must escalate the case on day 4 or within 30 days from opening the case, and eBay will step in and force the refund.
Do not close the case early for any excuse or promise the seller may give, and do not forget to escalate.

Hi mrl196603, thanks for your post.
If you confirm the item number for the transaction in question, I'd be happy to send it for review for you.
Thank you,
Marco
