Dispute

I'm been harassed by a Moorcroft. Ref 008312037145.

This is for an item a seller canceled but ebay took, want commission on a sale that didn't take place.  

 

I find this action appalling and is now affecting my metal health. 

 

How can I be charged for something I have not had.

Assuming this is when private sellers were charged fees, there were a number of ways those fees would still be due even if a sale didn't go through.

 

Only you know if the fees were due, but if they were, you need to pay the debt.

an educated guess by looking at your feedback profile is that it was an item you did not get paid for [false positives you left] but did not cancel with - buyer did not pay - so you owe fees.

As I said I was on holiday with limited access to WiFi and limited knowledge of how to make the refund.

One week is a very small amount of time when on hoildays.

If I had been in hospital would it be the same outcome.

I will have to let Moorcroft take me to court to explain what ebay has done.

You know this is wrong.

Expanding a bit on the other posters if a buyer does not pay then eBay has a wonderful tool. After four days from the sale the seller opens a "non payer case" and if still not paid escalates the case to eBay.  

 

The buyer will be given an account defect, the seller gets a fee credit and neither can leave feedback.

 

It is also against eBay's rules to leave "false positives" for buyers.  They could sanction you just for doing so I'm afraid.  There is no option to leave a red dot  

 

 

 

The difficult thing though is that unless the seller uses this the eBay fees are due.  I am sorry but if you do not pay them then the first thing that will happen is that they will restrict your account so that you cannot sell. If you still do not pay they will ban you indefinitely from which there is no way back. 

 

I very much doubt whether you would succeed at any court hearing; eBay's rules have been in place for decades.  They - no doubt - had them drawn up by skilled lawyers!   @wood4538

As you not regulated I doubt you have any legal rights, just bullying tactics

An organisation does not have to be regulated for your agreement with them to be legally binding.

So you think its right to charge when someone is on holiday. And if you read the messages I told the buyer I was away.

You know it's wrong.

Looks like I'll have to go to court, shame on ebay.

Normally buyer would message to check the items still available.

This is why I think I've been scammed.

Just to be very clear you are posting on members forum,  this is not ebay, you are talking to other ebay buyers and sellers.

 

The question is  how much money are you willing to owe on a point of principle?  At each stage this will get more expensive with court fees etc, and is it worth all the stress?  This could  end up affecting your credit history, and affect things like mortages or loans which is where the most damage is done.

 

To use ebay you have to agree to their terms and conditions.   Your cheapest option would have been to pay the original (much smaller fee),  or immediately try customer services to see if they would credit you as you'd not completed the correct procedure in ignorance.

 

Try the MSE (money saving site)  as there may be methods of dealing with the claim now its gone to debt recovery.  They have a lot of forums dealing with fines, debts etc.

Ebay have lost money through trying to rip me off. I have not bought or sold items on eday sice they charged be almost 50% of the items value.

I simply do not have the money to pay the dishonest amount eday claim I owe.
