I have always trusted eBay and have made many purchases based on that trust. However, I recently realized that one of the sellers has sold a fake item while advertising it as an original.

I made this purchase because I trusted eBay, but now I feel that this seller has taken advantage of that trust.

I would like eBay to investigate this matter and take appropriate action.

select "Doesn't match description" and if necessary escalate it to eBay after 3 complete working days.

Hello,

I have not received the parcel yet, but I have a question.

If the item is subject to customs tax upon delivery, what should I do? Since this situation is not a simple return — the seller has sent me a fake item while claiming it’s original and even included an invoice — I believe this should be treated as a case of item not as described.



If taxes and return costs are involved, I believe I should be fully refunded for everything, including the item price, taxes, and return shipping.

Could you please clarify what I should do in this case?



Should I refuse to pay the tax upon delivery and request a return instead?

If you don't pay the tax and accept the item, you'll be unable to claim that it's fake and not as described.

 

Once you have the item, open an eBay return and select the 'doesn't match photos or description' reason.

 

You'll need to apply to HMRC to get back any import fees, the admin fee (if there is one) won't be refunded though.

eBay will enforce the refund of the item price and postage.   They instruct overseas sellers to pay return postage but it's harder to enforce than if the seller was in the UK.  

 

You'd have to claim the  Import tax back separately.   See: "If you’re charged too much or return your goods" on here:

https://www.gov.uk/goods-sent-from-abroad/tax-and-duty

 

If you don't pay the import duty you won't receive the item.   That refusal may cloud the "not received" issue so it might be safer to get the item and do a return.

Hello,

I’ve just realized that the item is fake. The seller originally claimed that they only had one and were reselling it because they regretted their purchase — which is why they were offering it at a lower price.



However, after I purchased it, the exact same item was listed again with the same description. This clearly shows that the seller is repeatedly listing fake items under false claims.



I believe it is eBay’s responsibility to investigate this. If my claim is confirmed, the seller should be held accountable — including covering any import taxes I pay. Also, eBay should prevent them from continuing this behavior, as someone else might end up buying this counterfeit item again.

eBay is merely a selling platform, your trust is misplaced.

 

Sellers are responsible for their listings, and you must follow eBay's process for returning an item you receive if it turns out to be fake.

 

You can't claim that it's fake unless you have it, no matter what else may indicate that it is.
