item was collected from seller on my behalf, at home i found issues, sellers listing dosent describe

i made an offer on a car door, photographs and listing it looked fine, as i was at work, i made an offer and the seller accepted, i paid through ebay and my brother collected in my behalf, they loaded the item into my brothers car, when he got to the garage to where it was to be put on my car, he sent some photos on scratches and dents, which are clearly visable on my brothers photos, i checked the listung photos, and to me it looks like they did something clever with the photo, as no marks or dents can be seen, i messaged seller, who seemed like was ignoribg me, till i mentioned ebay, without going on, i asked for a partial refund as the item didnt match listing, for the seller to tell me, he spoke to ebay and he told me beacause it collection in person, they cant do any refund, then decided it was someone higher than him at work that had said no ti any refund, hiw do i stand and how do i speak to ebay, iv tried all day, and cannot get to soeak to someone

As you didn't collect in person you are not covered by the moneyback guarantee.

Your brother should have checked it over at the time of collection and refused it if any faults were found,as it is the seller could claim it was ok and accepted by your brother so any damage could have been caused by him.

The problem is that eBay rules require that either the seller arranges a courier [who can issue a tracked receipt showing delivery] or that the buyer personally collects the item. 

I suppose that the reason is that when the buyer turns up they can see [at that time] the condition and any faults and decide whether to accept.  The  seller could simply say it was fine when it left them and any damage occurred later.      @assakin
