ebay rules and special delivery items

i send my items special delivery, but with ebays new payments rules on the funds on hold until its confirmed as delivered, i have a problem, so i have checked the tracking for an item sent special delivery and it was attempted today but no one in, so what happens to the payment that is on hold, its not my fault there was no one in as the buyer was told it was special delivery

In theory attempted delivery is good enough to win a not received case, but do not know whether it is good enough to get money released.
