Hi,
I contacted the seller. We went to the address to have a look on the car. As soon as, we start the car, it made a noise in the engine. We told him we want the car but he must repair the car and eliminate that noise first.

Sorry, but there is no ebay MBG for vehicles, not even for deposits.
This is between you & seller.

You'll need to turn to legal advice how to get your money back here.
You must never leave deposits for vehicles, and only pay cash or bank transfer when the car and paperwork has been fully inspected and all good on the day, and not rely on a promise from the seller to ' get it fixed'.
There is no buyer protection for buying vehicles on eBay, but you also strayed out of the rules.
Most legal advisors do offer a half hour consultation for free, see what they advise as to how to get your money back here.

There is no buyer protection for buying vehicles, but there is no need for deposits full payment is only required if everything, vehicle and paperwork checks out to your satisfaction.
eBay cannot help you here, they offer no protection, as said, for vehicles.
I suppose you could send a polite message to the seller, saying you require your deposit money back within ** days, or you will need to turn to legal advice for help. That may spur them to refund you.

You have my sympathy.
My son-in-law did a similar thing. He paid a 200 pound deposit to a presumably reputable B&M garage for a car which he later decided not to buy and they refused to give him his deposit back even though they had a sign up saying "Returnable deposit"
He paid by bank transfer so assumed he could do a chargeback with his bank card.
Unfortunately the bank refused to refund him.
My advice? Never pay anyone a deposit. Especially someone you don't know and have never met.
