Seller's courier damaged my property

Hello,

I bought a sofa from a business on eBay.  The courier they used damaged my property and it will cost around £400 to repair.  The seller states that I only have a claim against the courier, but there are two issues with this:

1) I have no contract with the courier, and actually no idea who they are.

2) The seller advertised the sofa as 197cm wide, which fit exactly under my doorway when stood on its end.  In fact it was 219cm tall and would never have fit - this is how the damage happened.  

I can go via MCOL to recover my costs but it will take a long time, and I just want this resolved.

Any discussion of similar experiences and outcomes would be welcome.  Thank you!

Rubbish!  

 

Simply open a "not as described/damaged" case with eBay from "other actions" in your purchase record.  

 

Seller must make arrangements to collect and refund you.  

 

Do not contact the seller to discuss/argue as he obviously wishes to deprive you of your legal rights.  

 

The problem is - of course - that eBay may simply send you an RM label for a 2kg parcel which will not work for a sofa at the Post Office!   If that should happen you will need to contact eBay customer services.

 

The seller has 4 days to send details of how to return [at his cost].  If he does not do so escalate the case and you should get a refund.  

 

Do not take any notice of offers to repair etc.  Go for a refund and have no more to deal with the seller!

Hi, thanks for your response!  They have already taken the sofa back and refunded it, the problem is the out of pocket expenses caused by the courier.

Unfortunately ebay won't get involved with this.

It is between you & seller/courier.

Why did the refund not include the delivery costs if you paid the seller?

 

If you made two payments to the seller, exactly how did you pay the delivery costs?

Thanks for your reply. Delivery was “free”. The seller refunded the whole amount I paid: the out of pocket expenses are due to the damage caused by the courier. 

I think I will have to go via the small claims court.
