Seller described item as new however it was damaged.

I have been on holiday and just noticed that an expensive item I bought that was described as new has damage on it.  The damage can be seen on the original sellers photos however he has used a number of stock photos so the damage isn’t obvious unless you zoom in, however, you can see it.

The seller will not refund and unfortunately I’m just outwith the 30 day money back guarantee.  I received confirmation that eBay will look after me from the first assistant I spoke to however, when I chased a status update the next 2 assistants said they cannot do anything.  My rights outwith eBay would be return to the seller for repair or receive compensation.

It does seem very unfair.   Anyone got a similar experience with the precedence of a more positive outcome? Looks like I’ll have to go down the Section 75 route but Ive no confidence that’ll work against eBay.  TIA.

eBay's 30 day MBG Money Back Guarantee has strict timelines,  that is,  you have to claim when receiving an item not as described,  within that 30 day deadline.

 

You can turn to your payment provider now,  for help with a refund, most will offer a longer protection period.
