I recently tried to buy 3 boxes of a supplement. The seller has sent 2 boxes last week. I opened a case with eBay about the missing 3rd box. Seller has got back to me to say there is a delay providing 3rd box and says he will refund me but in order to do this I need to close the case with eBay?? If I do this and he doesn’t send ítem I have no protection. He is saying because I have opened case for whole purchase it will not let him refund only 1???

Do not close the case.  You are right that you will likely hear no more if you do so!

If you order 3 and get 2 you must open a "Not as described case"  opening a "non receipt case" will not work as you did "receive something".  

The correct way to deal with it [and silly perhaps] is that he sends a label you return the 2 and he either refunds in full or sends out the 3

Best keep the case opened,what reason did you give for opening the case with ebay,the case can be escalated to ebay after 3 days if seller isn't refunding the missing item issue.
