So this 0 rating seller hasn't sent my items nor will accept the cancel request.
Messages show seller doesnt care, hes just taking the mick.
Ebay chat doesnt work hasn't worked for a few days. Cannot contact anyone.
Ebay told me I can make an item not received case from today but now its saying the 2nd of October.... still cannot access the chat to contact a rep.

It has to be after the last estimated delivery date on the listing. So when that has passed select "Report an item you didn't receive" on here:

and escalate it 3 complete working days later to get a full refund.

What rep told me the other day if it wasn't sorted within 3 days I would have a refund the next day. It's now been 4 days and I am still stuck and I can't even contact help because it's all bugged for me.

EBay told me the other day I would have my money back after 3 days. 26th september-now. It won't let me do nothing on my account

They were probably talking about the 3 days you have to wait to escalate to ebay after you've started the claim. They won't speed up the date you can start it because you have to allow time for the item to arrive. So you have to wait until after the estimated delivery date.

I have messages from the seller telling me he's not sending it ect and EBay did tell me I would have my money back tidy I have the transcripts. Now I can't access automated chat. And I have to wait another day... Getting a joke now the

Refunds / cancellations are all automated, no messages are taken into account.
They are also timed to the second , so your case for item not as described can be escalated exactly 3 days, exactly 3 x 24 hours, after opening for eBay to step in and refund you, and not a second before.
The earliest you can open the case as advised, is one day after the item's last estimated date for delivery.
It may be frustrating, but those are the rules.

YOU have to escalate case on day 4, it is not automatic.
