Phone with warranty

I have bought a phone, the phone is eBay refurbished with one year warranty, it’s failed after 6 months and the company kept putting me of stating send photos etc, eventually they said it’s damaged when it’s not. I took my phone  to independent store that said it’s a common fault with Samsung flip phones and they should fix under warranty. I feel ripped off, the company should take it back to assess, the phone is faulty not damaged. Over 90 days so eBay is difficult to deal with, what is my next steps?

I doubt that eBay will help with guarantee the Money Back Guarantee lasts for 30 days [not 90].  

 

Your best bet I think is to get your payment provider involved.

Any guarantee the seller provides has nothing to do with eBay. Their own money back guarantee only lasts for 30 days. After that they have no interest.

 

Promises of guarantees by eBay sellers are often worthless - we get more questions about this than almost any other subject. You can't say that eBay didn't warn you. The user agreement specifically reminds buyers that "they do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions". Buying on eBay isn't like the shops. eBay is a jungle.

 

If the maker's guarantee doesn't apply, your payment provider e.g. credit or debit card issuer might be able to help. Failing that, if your seller is a registered UK business seller you might have some statutory consumer rights - but having rights is one thing; being able to enforce them against distant eBay sellers may be quite another. Good luck anyway.

Was it covered by the Ebay Refurbished Guarantee?

This is the important bit:

 

'All Refurbished items come with a minimum 12-month seller guarantee (available on orders sent to a Mainland UK delivery address). The guarantee covers any defects in functionality.

Once your order has been confirmed, the seller will send you a separate email with details of the seller guarantee, what's covered and their contact information. Alternatively, this information will be included in the parcel when the item is sent to you.

Please make sure you hold on to this information for the duration of the guarantee.'

 

You have independent evidence of the fault.  If this is covered by your guarantee, contact the company again, in writing would be best, and tell them that you will be taking further action.  You will need your email and you will need to check that the issue with your phone is covered.
