If the seller can show ebay the item was delivered then that is all that is expected of the seller,so you won't get a  refund.Sellers are not responsible for what a delivery person does with your item.

What do you think ebay should do then? You will not get a refund from them or the seller.

 

Seller has done all that is required, and there is nothing ebay can or would do.

As far as eBay is concerned, you won't. eBay's policy (which you accepted in the user agreement) is to go by the tracking record. If this records that an item was delivered thy will not require the seller to refund you.

 

eBay's money back guarantee is is addition to buyer's statutory rights. There are all sorts of theoretical legal arguments that the seller should be liable for the actions of their courier. In practice, the law and evidence required are so comlicated that it simply isn't practicable to go to court over something the typical value of an eBay parcel.

 

The reality is that parcel deliveries, especially by budget couriers, have become like the Wild West!
