Item recalled due to safety concern.

Had email from ebay that one of the item I bought has been recalled due to safety concern. Sent email to seller, no response. It is outside the 30 day ebay rule. In this instance, surely ebay would be liable to pay me the refund.

Sorry no,  eBay is not liable here.

 

Many receive these messages from time to time,  it's eBay's duty to just inform anyone buying the item,  that there is  now an issue.

 

Outside eBay's 30 day strict timeframe for a refund,  you can turn to the manufacturer of the item,  see what they suggest if and what, are your next steps.  Some have required the item to be sent back for them to refund, but you will have to contact ,as said the manufacturer,  see what they say.

Nobody seems to read the user agreement!

 

Section 2 makes it clear that sellers are entirely responsible for their listings. eBay even warns buyers that they don't guarantee that items sold here will be safe, or even legal.

 

Atter eBay's own 30 day money back guarantee has expired they have no further responsibility or interest. They will pass on recall notices to buyers, but responsibility for any action required rests with the seller.

 

Many eBay sellers don't want to know, in which case you can only try the manufacturer, to see whether they can halp, or consult itizens Advice or Trading standards, if the seller is in the UK. You might even end up having to bin the item.

 

These are just some of the risks of buying from unknown sellers here. Buying on eBay isn't like the shops.
