Im being punished for canceling a item

Hi on the 1st of October I bought a item on Ebay then soon after i cancelled the item or put in a request to cancel 

Well yesterday the 4th October  late evening i got a message saying the seller refused my request i checked to see if it had been posted but no this morning still not posted then this afternoon its back up for sale and I'm left without a refund or nothing ive messaged the seller but no reply i feel like im being punished for canceling my order this should be happening please help ref 10-13647-33156

You will have to wait until past the expected delivery date and THEN open a not received case to get a refund.

Rather foolish of seller as it just wastes his and your time, for refund he will have to make.  Could be he had no idea what to do, but it is all so easy.
