Hello I recently received a purchase which was damaged on arrival and have been given a refund. I still haven't received the return label from the seller in my messages after a week and understand I can ask eBay to step in after 3 days. Every time I contact eBay I am told the case is closed and I can't get any further with the return label. I don't want to have to call eBay because they keep you holding for ages

If you have already received the refund, then you do not have to send the item back.
Sometimes it's not worth the return postage cost against the value of the item, and the seller just.
refunds.

If the item was sent using Simple Delivery, and you started a return on the basis that it was damaged in transit, then you will have been compensated by Ebay and not the seller.
They refund you, the seller is paid for the item, and you can dispose of the damaged item however you see fit as it is yours to keep.

Wow! I hadn't realised this. Are you sure it's correct? If buyers can keep damaged items I can see an awful lot of buyers claiming minor cosmetic damage to get them for free - even damaging them deliberately if eBay requires a photo. This could be a very expensive policy for eBay.

I completely agree!
Obviously, I am not going to offer any 'ideas for scammers' here, but this is wide open to abuse by sellers and buyers.
I suppose the thinking is that the seller will be paid so they are not entitled to the item back and Ebay don't want it so buyer keeps it.

Those comments were really not aimed at you. There is no suggestion that your claim is false or intended to scam anybody.
It was a general expression of surprise regarding Ebay's new policy.
