Anyone know what I can do if I returned an item for an exchange agreed by the seller that I didn't receive nor been refunded for. Then they conveniently went 'out of the office' for the month that took the purchase outside eBay's Money Back Guarantee? So how could I possibly have done anything about this within the timeframe? They're still not responding even now? And eBay are unable to do much about it? This just can not be right?

The seller played you for time and won. Knowing you cannot claim anything outside eBay's 30 day MBG policy they kept making excuses and now you have no claim under eBay's MBG to put in a claim for any refund.
Firstly, never ask for an exchange if the second item is faulty , you are not covered for any refund, open a case for a refund listen to no excuses from the seller, and you must escalate the case if not refunded within the specified time.
You will need to turn to your payment provider now, for help with your refund.

By opening a case under eBay's money back guarantee.
Being "out of office" would have meant nothing. The seller would have been required to respond within three working days. If they didn't, you could have escalated the case for eBay to step in and they would have enforced a full refund.
Buying from unknown sellers on eBay isn't like the shops. The user agreement warned you about the risks, that "eBay does not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions".
The onus is on you to read and understand how eBay buyer protection works, and use it. It's too late to do anything through eBay now, but if you paid by a credit or debit card your card issuer may still be able to help.
