Buyer wants to return an item because they dont NEED it anymore

Buyer has payed and it has been dispatched but the courier is behind in delivering it to the buyer the buyer has then opened a buyer not received case and in which i messaged her and told her the situation to which she replied “its alright i dont need them anymore the even is over now I’ll just return them” 

Am i obliged to refund her even though nothing is wrong with the item and it hasnt arrived yet

You're not a business seller so you don't have to accept "change of mind" returns.    However,  late delivery means a buyer can open a "not as described" return which you would have to accept.    So it depends on which reason she uses.

as the buyer has opened a not received case you have 3 working days, from the date of opening, to refund unless tracking proves delivery.

Yes, you probably are.

 

If an item has not arrived by the latest estimated delivery date the buyer is entitled to open an "item not received" case under eBay's money back guarantee.

 

If the item arrives, but later than the latest estimated delivery date, they are entitled to open an "item not as described" case. 

 

If the item arrives the buyer has already opened a "not received" case, if they no longer want it they can probably get eBay to change the case to a "not as described" case. In this case, as well as refunding them the seller also has to send them a prepaid return label.
