Tell the seller to issue a cancellation on ebay. If they don't do that when the estimated delivery date on the listing has passed select "Report an item you didn't receive" on here:

and escalate it 3 complete working days later.

The seller will need to accept the cancellation request which in this situation they should be happy to do as they already confirmed the item was sold to someone else. Once they accept it, it will start the refund process.

A seller should not be allowed to avoid a transaction defect by forcing the blameless buyer to cancel to get their due refund.
Neither should they get away with citing an incorrect cancellation reason.
Furthermore, eBay Customer Service explicitly state the following
"If buyers have excessive cancelled orders for unpaid items or make excessive requests to cancel orders, they may be subject to the consequences outlined in our Unpaid item policy and Abusive buyer policy"
