This is bad selling , but no one can force a seller to send out an item. You can leave appropriate feedback.
If the seller will not cancel the order this will fully refund you, you'll need to wait one day after your item's last estimated date for delivery then open a case for item not received.
If not refunded in 3 days, escalate the case , eBay will step in and force the refund.
