Item arrived damaged, seller is reporting me for fraud.

 

I recently bought a motherboard that was listed as opened - never used, i opened the package as soon as it arrived and i noticed the cpu socket cover had come off and multiple pins were bent. Seller says it's impossible to happen because of the foam inserts and i think it's due to being damaged in transit. Seller is now threatening me that he is reporting my account for fraud when i really wanted this motherboard to use in my pc build. Unable to get into contact with an ebay agent since it won't let me connect with a human being to help me out.

The odds are ebay will find in your favour (I'm assuming you've started a return)  but it will help to counter the seller's report so contact ebay about it using callback on here:

select "Doesn't match description" and if necessary escalate it to eBay after 3 complete working days.

Don't take any notice of the seller, just open a return request using the reason 'Item arrived damaged' or 'Item doesn't match description or photos'.  The seller will have 3 business days in which to either issue a pre-paid return label or just refund.  If they don't do either within that timeframe then you will be given the option to 'Ask eBay to step in and help' and eBay will then force the refund.
