Have to wait 40 days for a refund

On the 26th of September I ordered a  Samsung tablet from a troll "seller" that never sent it and after my communications went unanswered I cancelled the order a few days later and the troll "seller" accepted the cancellation. Unfortunately the cancellation didn't go through for some unknown reason and now I have to wait 35 days (30th of October) from the day of purchase to start an "item didn't arrive" dispute because the troll "seller" set the handling period to 20 days, obviously one needs three weeks to package a single item and take it to the nearest post office and then that item that should have been sent with special delivery needs another two weeks to travel the four hour distance between me and the troll. 

 

The troll admitted on a private message that she won't be able to sent the tablet and thus there is no tracking. Yet eBay tell me to wait 35 days and take no responsibility for the failure of their system  to cancel the order. I didn't care until yesterday when I had an unexpected expensive mechanical issue that is preventing me from going to work and now I need that money asap. What can I do to get it? Customer service is of no help so any help is appreciated.

The money back guarantee says you have to wait until the day after the expected delivery before you can open a case for item not received, that can't be changed.
