Do eBay actually check the EU Responsible Person details?

Just been browsing a listing from a competitor that eBay kindly suggested I'd be interested in, and I noticed they are still selling in to the EU - something I stopped last year as I can't justify the cost of engaging a representative within the bloc.

 

Looking at their listing, the details they have for the EU Responsible Person are their own UK address - which of course isn't valid as said responsible person has to be within the EU.

 

eBay appear to have happily allowed them to list this, so what's the point of me having cut off part of my market when others can seemingly ignore the rules, avoid the expense and carry on?

How do you check if a seller has GSPR details and who the responsible person is for that company/item?

Towards the bottom of the listing there will be a Safety Information section, with a link to the Manufacturer / EU Responsible Person.

 

Presumably if this isn't present then they haven't provided one and therefore aren't (shouldn't be...) selling in to the EU.

Though as you can see from this thread. I’d take any of the information you see regarding GPSR responsible persons with a sackful of salt.

Yeah thats what I thought..... with the Windsor Framework coming in at the end of the month, I wonder if eBay will do anything about it. Probably not, maybe kick it down the road or pass the load back to the seller to deal with.  *Technically....* sellers who sell into NI/EU without that information should receive either a big fine from UKGov for any items sold into NI/EU without the correct procedures or their items will just get returned to the seller at the sellers cost but I think that would rely on UKGov doing their job.

GPSR isn’t anything to do with the UK Government as it’s an EU directive.

 

they can be fined by each member state of the EU though

Why would HMRC have any role in policing an EU product safety directive? They don't even police product safety regulations in the UK as that is the OPSS's job on a national level and Trading Standard's job on a regional level...

Give me ambiguity or give me something else.

HMRC are dealing with it because if you are moving goods regularly into NI/EU and you need to apply for goods not at risk as part of the IMM / IMS (internal market movements / scheme)

Apply for authorisation for the UK Internal Market Scheme if you bring goods into Northern Ireland -...

The last one is actually from HMRC.

Also as it's a customs issue because its crossing a border - His Majesty's Revenue & Customs - HMRC.
