I've read the cut off for being made to use direct postage is £10, besides it looking a bit weird as a listing which i guess you can explain in the item text could you not just list an item for £9.99 with say £30 postage if you wanted to sell it for £40?

Fairly certain there are ebay policies around overcharging or excessive postage (which that certainly would be) and also circumventing and avoiding fees.
Also, as has been explained in other threads, there's a policy on business sellers - but looking for loopholes is fun too I suppose.

You could argue that eBay themselves are overcharging for the simple delivery postage rates as they have already charged a buyer protection fee on each item as well. And the rates are far higher than you can get of the royal mail website even without a business account.
The original poster that's why we originally had to start paying fees on postage as well as the items cost as it was low/free to list at 99p & were charging £50 p&p to get around the fees
