Raising a court recovery claim against Ebay

I am raising a court recivery claim against EBay (uk) for interest on my witheld selling funds. Can i suggest to anyone who is experiencing this dubious and frankly damaging behaviour from Ebay do the same. Sellers need to take a stand against EBays dubious practices  Also lodge a formal complaint then escalate to the FCA when EBay deny your complaint Which is what they do as a matter of coarse!

How to make a court claim instructions

Go to- MCOL -website register for an account and follow instructions . Its a simple process and  you can charge fees and damages to Ebay.

Ebay will hold payments for up to 30 days for new sellers especially for higher priced items.

 

I'm guessing they have it all covered in the user agreement.

How on earth do you expect to win something like that, when by continuing to sell on Ebay, you have agreed to their T&C's.  It's far from illegal for them to do this kind of thing, as many companies do exactly this.


If you go ahead legally, then it's likely to cost you a lot of money for nothing.

 

Its a simple process and  you can charge fees and damages to Ebay.  

 

There is a very important caveat to that statement "If you win, you can"!

Clearly you have not read eBay's T&C which all who use the site signed up to.

MCOL is the online version of a Small Claims Court.  I would have thought that the only grounds you might have to complain about ebay withholding funds is that of "Unjust Enrichment" and "Unfair contract terms", but I doubt that a Small Claims Court could deal with that.  Presumably you will keep us posted.

You know that you agreed to this - it's all in the User Agreement - you may recall that you ticked the box to confirm that you agree to the terms and conditions.

Just to add, I can see exactly why Ebay have put a hold on your funds.

 

New member joined days ago!
And between the 28th and 31st of July, you have sold about £7000 worth of goods.

Can you not see why they might want to make sure that you are a valid, legal seller?

That is a hell of a lot to sell in just a couple of days on a brand new account with zero selling history.

I can't see any listings when I click the link from their profile - is there some other way of seeing them?

 

I can only see from their feedback that they've sold around £1800 worth of goods, but that's 4 items without feedback that I can't see the value of.

 

It's an enviously high feedback score - 7 out of 11 buyers have left feedback in just a week!

Quickest way - click on their feedback score (7).

 

Click on ‘View Items for Sale’.

 

Scroll down to and click on ‘Sold’.

I hadn't noticed that one, but looking back.

If you sell something at £3k, then why sell it again at £1500....

 

That's a hell of a discount.  And I notice that the first sale is with authenticity guarantee, yet the second not.

With the description of the said rare vintage pendant and chain being about as vague as you can get, I am utterly surprised it sold at all. I bet they where rubbing there hands at the price they got.  Even with a 50% discount.

Must admit, I did notice that.
I can't imagine spending a couple of grand without at least knowing what kind of gold it is.

Though one of those pendants was obviously for someone in particular, with the name being mentioned.

So it could simply be that they are being marketed elsewhere and just using Ebay as the cash out option.
