Following a transaction on eBay, the package was sent with AWB track at the beginning of December. But due to large deliveries and the winter holidays, the package was delayed for about 2 weeks. The buyer opened a complaint immediately, won and his money was returned. The complaint period was only 6 days!!, and after 5 days the package was delivered to him, it appeared on the tracking and on eBay. I opened an appeal against the decision where I was told that, "it was taken into account that the buyer should keep the money even if the product was delivered, and that I should come to an agreement with the buyer for the money and they can do nothing more"
It does not seem fair to me that a buyer should keep both the money and the product, to provide evidence that the product was delivered and eBay to say that they have nothing to do!!
What should be done in this situation?

Have you contacted your buyer to let them know that you're glad to see that their item finally arrived, and do they want to keep it and send a payment (either via PayPal or bank transfer) or do they want you to issue a pre-paid returns label so that they can send it back?

The buyer stopped responding to messages, he was very active until he got the money, now he's not interested anymore

I would assume requesting this might result in a ban, you are not to discuss outside payment methods on ebay and i'm surprised if customer service really told the seller to do so.

They've been in a transaction for that order so it wouldn't be against eBay policy for the buyer/seller to exchange contact details at this point to discuss a payment arrangement.
eBay Customer Services gave the correct advice here, this is no longer anything to do with eBay so needs to be pursued outside of eBay.

I fear your last resort will be the small claims court, wait and see but you'll need to send a letter before action to the buyer as they cannot have both money and goods without your agreement.
What i do is tell they buyers that I will send a refund but to understand should the goods be later delivered as shown in a deliver scan i expect the good to be returned if alternatively they wish to keep them i will arrange for them to make a payment.
But you need to play it buy ear.

This happened to me, as a private seller, for a relatively small amount of money (£35) in the whole scheme of things.
I contacted them by eBay’s messaging system, asking for payment or the item and they ignored me so I requested their telephone number from eBay. I texted asking the same and got blocked. Texted from another number, same.
so I decided they weren’t getting away with it
I printed off the order details, every email, every text etc and then sent them a letter recorded delivery stating that I would accept payment within 7 working days or I would commence action within the small claims court.
ignored that too.
I’ve had enough of being scammed over the years and being let down by eBay as a seller so I filled in the paperwork for the court process.
You’re asked to provide a timeline of events so note everything down.
they got their letter and hey presto, their £35 item turned into £80, paid in full immediately
sometimes, even for small amounts it’s worth it on principle
mid it’s a similar amount I’d say do it. Don’t let them get away with it

That's what I understood from their answer, I accepted that at the time of the complaint the product did not arrive, but after it arrived I appealed the complaint, the answer is in Italian, I translated the last part for you, as far as I understood it says as.
,,Then, however, agree on payment for the item with the buyer once the item has been delivered."

Looks like they are in Italy so couldn't sue the buyer but I think a letter to ebay could be in order, ensure they understand what happened. They are as it stands facilitating fraud after all.

If you are in Romania and your buyer is in Italy, I'm not sure that's going to work!

Good for you, I am sick of being scammed by some buyers, you never get any assistance from ebay, they do not want any hassle , always easier for ebay to side with the buyer / scammer.
