if in relation to the negative feedback you left no one can get involved as you say "so I have started legal action to get my money back"

eBay has a 30 Day Money Back Guarantee under which you can return an item that isn't as described and get a full refund.
It's nigh on impossible for a buyer to lose out unless they go past the 30 day timeframe.

Open a case for "Item not as described"
The seller will send you a pre-paid label
Return the items using the label, and eBay will force the seller to refund you 2 days after the item is delivered
There is no need for legal action, just use the eBay Money Back Guarantee
To open a case, go to the item in your purchase history and click "More Actions" and "Item is not as Described"
The seller cannot refuse to refund, eBay will take the money from the seller and refund you once you have returned the item

The item was delivered but was less in amount.I immediately requested a full refund but the seller calculated that the shortfall in amount equated to a 23p refund.I have never requested the refund for the shortfall but the seller says as I have opened the package they will not give me a total refund.The item in question is a bottle of vitamin supplements. Why cannot I get a full refund.

Ebay have not responded for almost 10 days when I opened an action for item not as described

You have to add thr tracking number of the returned item to the case then click the option "ask eBay to step in".
If you don't the case will not progress
If you did not use tracking when you sent it back then you won't be refunded any more
It doesn't matter that it was a food item, if it was not as described you are due a full refund
Add the tracking number to the case and click "Ask eBay to step in" option

If the seller doesn't respond and issue you with a pre-paid returns label, after 3 business days (which has now passed) you'll see a link to ask eBay to step in.
Use that and eBay will either send you a pre-paid returns label or refund you.

Your seller cannot refuse a return unless you selected the wrong reason.
Is the return case still open?
If so escalate it to ask eBay to step in, tell them that you haven't been issued with a returns label.

Most eBay returns labels - except for large or heavy items - are Royal Mail Tracked 24/48. There should be a QR code on the label - that is all you need. Take the item and your mobile device to a Post Office counter - they should be able to scan the QR code and print the label for you. You might need to "zoom in" on the QR code for them to be able to scan it.
Currently it is your responsibility to use the label and send the item back. If you don't use the label in time you will lose the return case and the seller will not be forced to refund you via eBay. If you open an INAD case and the seller (or eBay) issues a return label you must use it to return the goods in order to receive a refund.

the system is set up, the instructions are 'pretty clear' so i do not understand your problem. Others on here have given sound advice and then you say that you cannot get a label, could i suggest that instead of complaining you find a solution yourself to the label problem. Do you not know anyone that has a computer/printer that could sort it out for you. As for the seller being a scammer, maybe he is, maybe he is'nt. If the bottle was sealed maybe it was the manufacturer who made a mistake?? As others have said, the way the system works he will have no choice but to refund you but you have to follow the system to get that result.
