Buyer claims not received within an hour, but photo shows delivery

I sold an item last week, added tracking information like a I usually do.  Buyer lives in a flat it seems.  It was delivered yesterday at 3.59pm, but at 5pm, the buyer messaged to say they did not have the item although it showed delivered.

 

I checked the tracking, it was left in some kind of meter cupboard, so I gave the picture to the buyer.  They then said it was a communal cupboard and started asking me why it was left there and why did the courier not leave a card - I don't know the answer to that of course.

 

Today, buyer opened a case, stating that it wasn't delivered, but left in a meter cupboard without informing them.  They still claim they do not have it.

 

Will ebay side with me in this case?

They should do.   They normally go by the tracking to the buyer's address.   But of course you won't know for sure until the outcome of the case.

They should do according to their written policy.

 

However, as you're a business you are legally required to deliver the item into the buyer's physical possession. Your best course of action is to upload the tracking you have to the INR case then - when your buyer loses the case due to the tracking you have - you need to direct your buyer to file a dispute with their payment provider for not receiving their item. You should again be protected by eBay even if the buyer's financial institution decides they are entitled to a refund. 

 

What was the value of the item?

Give me ambiguity or give me something else.
