ive bought a item for £120 the seller has sent me the wrong item and sent mine to a different buyer. he is asking me to send the item back to him at my cost and will request my item from the other buyer, when he has returned it will post to me. what should i do?

Nope,  that is not correct , you are not liable for the return postage.

 

Send him a polite message that you are following eBay's rules and then proceed this way.

 


You have received an item not as described,  so you are guaranteed a full refund under eBay's 30 day MBG,  Money Back Guarantee policy,  if you claim within 30 days of the item's last estimated date for delivery.

You then go right of the item in your Purchase History,  and from More Actions select Return this item,  selecting the reason...  Item Not as Described.

The seller has 3 days to accept the case,  if they don't ,  you need to  escalate on day 4,  or within 30 days,  and eBay will step in and force the refund.

If the seller wants the item back first,  they need to pay for a fully tracked return postage.  On receipt of their item they have 48 hours to refund you.  Again,  if they don't,  you escalate the case.

Do not close the case early for any excuse or promise the seller may give,  and do not forget to escalate.

As advised, you need to open a case through Ebay, get a label from the seller, send the item back and get a full refund.

Opening the case protects you and keeps everything 'official'.

Getting a refund is the best way forward, even though you want the item you bought.

The other buyer who has your item may be uncooperative or slow to return the item they have received.

Once you have a full refund, the seller can relist the item for you to buy again.

This may all seem a bit long-winded and complicated but is the best way forward for you.

Thank you for your reply, yes i was thinking the same the other buyer may not be willing to return the item to the seller. my item is twice the price of the one he bought. i thought of keeping hold of the item until i saw proof my item had been returned to the seller and posted to me but yours seems the most secure method, thanks.

I know your instinct is probably to help the seller and do as they ask, but this is their error.

Open a return and let the seller sort it all out.
