package damaged by courier

I was expecting delivery next day service and went on for almost 3 days, i opened a case with seller on ebay for parcel not recived  i did track it  and found out my parcel was damaged by courier. I informed seller and they seem dont understand, but still trying to deliver me a damage parcel.... its now 6 days since i payed for my item and iam nowhere foward.....they tried to deliver yesturday but courier put down damaged as seller said i could reject it and it would go back to seller..... and i payed full for item tobe delivered in perfect condition and certainly not damaged item to reach me ... As the items is 24 X Dehumidifier Interior Damp Trap Mould Moisture traps  it contains  powder items in plastic boxes if  the box is damaged when i saw it yesturday then items would be damage too looked like somethink driven over it........ i cannot have powder chemicals leakages in my home due to health concerns...iam without my goods or refund from seller. 

And the couier still trying to deliver damaged parcel 

And to all top off doubt seller is been very understandable or helpful... what can i do...

To open a not as described return, you must have the items to return, at sellers expense.

Attempted delivery means you cannot open a not received case.

Only by dealing with this through an ebay case, will the refund be enforceable.

But  i opened a case with ebay because item  was supposed to arrive i waited 2 days without a next day delivery. And they only tried to deliver thursday yesturday a damage parcel the seller informed me i could reject it been delived damaged. I did just that so far no other communication had been from seller or courier. But when do tracking  the item keeps saying damage and they will deliver today. Well i saw delivery driver doing his next area rounds 2 miles away.And i had to goto hospital appointment  and when i got home there wasnt nothink left. So i went online did tracking again states item  could not be delivered as item is damaged 🤔

Did inform seller of this but guess be like any others be possible monday when i get reply from seller. That i be lucky in a reply.

It not my fault item was damaged it was couier that damaged my item and they expect me to honour a damage item. When i payed for a item that should arrive to me in perfect condition not looking like someone jumped all over it

Well seller adviced me that once they recive parcel back they will proceed me with a full refund on 17th of this month june...my ebay case was opened 3 days without no parcel delivery...the attempt delivery didnt take place till 5 days later and my opened case was still active 3 days prior to attempt delivery...the seller adviced me to reject damaged parcel after reciving message from evri that they had damaged the parcel...

You could be on a sticky wicket here, what the seller told you was incorrect. You should have accepted the parcel then opened a case that item damaged and not as described then returned the item.

By rejecting the delivery you are not covered by the eBay MBG.

Do update here then we can advise further if ebay or the seller do not refund.

It makes no difference, to comply with the ebay system to get a refund, you need to have something to return. 

You may be able to open a NOT RECEIVED CASE, but if delivery was attempted case would close and as you have nothing, opening a case for damaged item would also have nothing to return for a refund.

I opened case when parcel failed to turn up..

I followed the sellers indtructions of item that was damaged by evri..

Ive kept every single message between seller and myself...

This was message seller sent me at the time that evri messaged on my tracking history that parcel damaged...

Dear Customer,

Thank you for your message.

I apologise for the inconvenience caused, If its damaged then you can reject the item at the delivery time.

You say you opened a Not Received case. You were supposed to escalate your case after 3 full days so you would have been refunded by ebay. But it has been complicated by the fact you rejected the parcel because it was damaged.

Again, had you accepted the parcel you could have opened a Not as Described caseand got your money back that way. 

It is between you and the seller now. Hopefully he is waiting till he receives the parcel back himself to refund you.

Oh no you can't! You were misled. If the tracking record confirms that you refused the delivery I'm afraid you have rendered the transaction inelible for eBay buyer protection.

That's the danger of blindly following the seller's advice without first checking the terms and conditions for buyer protection.

I doubt you will get any money back through eBay now. According to how you paid or funded the payment your credit or debit card issuer or PayPal may be able to help, but again the fact that you refused delivery may count against you. Good luck anyway, but for the future do please read eBay's t&c for buyer protection. It's quite a lot to read, but more buyers lose their claims because they didn't know the conditions than for probably any other reason.
