inoperative smartphone, country issues ?

I ordered a smartphone, which was on Ebay U.K. , but shipped from China . It does not work with the sim I have -I.D. Mobile . The sim works fine in my 'phone , which is the same model as the one I ordered from China. The issue is clearly with the China 'phone. I have asked for a return authorization , but haveheard nothing yet. What I want to know, is  , as the 'phone appears not be be U.K. network compatible, who is liable for the return costs? I figure that under our sale of goods act, and possibly the distance-selling regulations, if an item is not up to what it is intended purpose is, a full refund of costs is in order . Anyone have a take on this?
