Hi, i ordered some pixel buds from a private seller on ebay. They were 'delivered' but the photo sent by courier (Evri) ended up being a related delivery for my upstairs neighbour. My parcel was not in the picture. Ebay have shockingly told me out right that im not being refunded and that i should persue the seller for reimburstment as they would have been insured with Evri.
The Evri package was sent using the eBay Simple delivery system. Does this not mean that Ebay are responsible for any reimburtsment as they would have bought the Evri labels on behalf of the seller? Even without this fact it seems a very unusual request from ebay.
The parcels in the picture were delivered to a comunal hallway in a small block of flats. Surely this dosent even count as a secure delivery? this is usually the case from my limited understanding.
I have sent them all emails to and from Evri as well as additional photos of the packages from the delivery photo kindly provided by my upstairs neighbour. You can clearly see the parcels are in the Communal area and that my small parcel is not there. I have told them what was in the other 2 parcels which are clearly way to big for earbuds, seller told me they should have gone though letterbox.
Seller has also stopped communicating with me since ebay closed the case immediatly after telling me i would not be compensated.
Whole thing seems realy weird and confusing, especially from ebay. This should be an open and *bleep* case surely?
I would REALLY appreciate some help.

The pictures are irrelevant.
What Ebay will look at is the tracking that the seller provided which is unique to the parcel sent from the seller to you.
If the tracking shows that the parcel was delivered to the correct address, Ebay will find in favour of the seller. Simple Delivery refunds the buyer in cases of non-delivery but obviously not if there is tracking which confirms delivery.
You said you have sent Ebay the emails to and from Evri. Do those emails confirm that Evri did not delivery your parcel to your building?
If you opened an 'item not received' case and Ebay closed it, you may have to try your payment provider. if you have evidence of non-delivery from Evri, pass that to your bank.

Thanks for the reply. The tracking for the parcel shows as delivered, the photo is from the courier site supplied from the driver with the 'delivered' message. but it shows a delivery for Flat 3 (i live in Flat 1 below) i have verified the contents of the delivery to flat 3 and sent these pictures to ebay (1 large box containing soft drink and a huge transparent package of kitchen rolls. My small (able to fit through a letterbox) package is clearly not in the picture. So the courier have lied. Contact with the courier hasnt been great, although i have asked them questions they have not answered, like why have i got a picture of Flat 3's delivery? where is my delivery? what did your driver say about this delivery when quizzed? they have ignored them all and just made a vague suggestion that it is 'lost'.
eBay contacted me today and said they would be refunding me but i had to fill in a Fraud online form for the police and send them the ref number. Thats great i thought but when i went though the form answering questions to sort me into the right category it said i could not submit a report because... (see attached image)
Ive forwarded this to eBay and am unsure how to procede, again.
