Wrong item sent

Ordered a car part and the seller sent the wrong part. I incurred fees from my mechanic for labour charges as they had taken the car part to fit the part only to realise the wrong part was sent. The seller is not looking to refund the labour costs.

eBay will not be able to enforce the seller to pay for those labour costs I'm afraid, that is between you and the seller.

 

Was it expensive?  You may wish to take legal advice then, as to how to retrieve that cost, if at all possible. 

 

Most legal advisors do offer a half hour consultation for free.

eBay can only enforce refund of item price and postage, as long as it's still within 30 days of delivery.    If you want to go after any more than that  and the value makes it worthwhile you'd have to consider using money claim online:

I can't see a successful legal claim here, to be honest. A mechanic should surely take a look at the part and  make sure it's the correct one before starting anything.

I think I'd be questioning the labour charge if the mechanic didn't check the part first, before taking the car apart. It's a bit cheeky of them to charge you, I feel.

Why didn't you wait until you had received and checked the replacement part before having the car taken apart? You are likely to be asked this if you try to claim against the seller

 

Mistakes are always possible. When buying from eBay sellers online you have to accept that returns and replacement are going to take longer. When you discovered the mistake, couldn't you have got a correct replacement more quickly locally?

 

It's up to you, but take advice before making any form of legal claim. It may not be as one-sided as you probably feel it is.
