Seller sold me a fake watch

I recently ordered a tissot watch but when it arrived it was a fake with automatic on the dial but powered by a quartz movement  the seller won't refund me and opened a case saying when I returned the item it was scratched and had missing links no mention it was a fake and shouldn't even have been allowed to sell this has been absolutely hell and I'm thinking seriously about deleting the ebay app if this case goes against me as I have told the truth and the seller gets away with selling fake goods. This seller has tried every trick in the book to avoid refunding me even lying.

If you are within 30 days of the item last estimated date for delivery the seller cannot refuse refunding you if you have opened a case for item not as described citing... Item Does Not Match Description or Photos.

 

Once the case has been opened the seller has 3 days to refund you or send a prepaid postage label for the return of the item.  If neither happen then on day 4 escalate the case,  eBay step in and force the refund.

 

Do not close the case early on any excuse or promise the seller may make,  and do not forget to escalate.
