Seller not fulfilling preorder

The seller has not fulfilled preorder, and  as its over 3 months ebay not interested. Been in contact with seller, and just get a reply, even to the point of offering another item which has also not transpired ,and insists that he cannot refund due to length of  time since transaction.

Sellers aren't allowed to list pre-orders that they can't guarantee delivery for within 40 business days, so he must've put a dispatch time of sooner.

However, eBay won't get involved at this late stage.

Did you pay with a debit or credit card? If so, you have 120 days from your payment date to issue a not received chargeback with them.
