Seller has received return and has refused to refund me and eBay open a case page  keeps displaying, its not you

Are you trying to escalate the case?    Have you entered the tracking number of the item sent back into the case details?  If not,  do so now.

You may be trying a little too soon to escalate.  After receipt of their item,  the seller has 48 hours to refund you.

This is timed to the second.  Once that lapses,  if there is no refund,  escalate the case,  ask eBay to step in and they'll force the refund.

It's been weeks now, seller received the return on 5th October, by the way the ask us to step page keeps bouncing me with "it's not you it's us, please try again"

In which case I would recommend contacting eBay Customer Services.  Show them that tracking has shown delivery to the seller and something is blocking you from escalating.  Hopefully, they'll be able to sort this for you.

Contact them now,  as the lines have just opened and there's more chance of Dublin answering.

I followed this and a representative called me shortly and resolved it for me, I got my refund within 48hrs as he stated. Nice work.
