i have purchased an item last night and paid but this morning the seller said his wife has given the item
away he has asked me to
cancel the order but I don’t wish to as I want the item, where do I stand

No one can force a seller to sell but you can't cancel anyway, the seller does that.

The seller will ask you to do it, so that it appears buyer requested so they don't get a defect on their account. It should be correctly cancelled as out of stock, which means as the seller they will get a defect. If any other reason appears once the buyer cancels then ensure you report them.

If they cancel as 'out of stock' which is what they should do, they will get a defect on their selling account.
However, this can happen to a seller - items get lost, broken or disposed of otherwise.
i understand you are disappointed but there is not anything you can do.

If you agree to cancel the money you paid will be automatically returned.
If you don't agree you would have to wait 4 days for the item to NOT arrive,then open a case with ebay reporting item not received, and basically just have to wait for the seller to refund,so a time consuming process.
