Scamming Seller

I bought an item for £170, last week, when it arrived it was damaged. i tried to initiate a return and chose the wrong button. This allowed the seller to close the case and every time i tried to appeal it says 'case closed, cannot appeal.'

I spoke and emailed over five people including a manger and they all said the same thing 'case closed, nothing we can do.'

Whats worse is this scamming seller was able to change the return policy after he found out i was trying to return the item. originally there was no mention about returns, then suddenly his post now says 'returns not accepted.' I have reported him as violating ebay terms.

I have been with ebay for over 20 years and am disgusted with them all for not taking any responsibility.

It says on the website that even if you choose a wrong option, and the case is closed, if the item arrives damaged you can return it, but i am unable to do this because i keep getting the same case closed message.

I am trying to get a chargeback from my paayment provider but ebay has not helped in anyway.

The seller has not scammed you. All items have a returns policy on so there could not previously have been nothing on the seller's items about returns.

 

It shows that you need to be careful and accurate when you start a return case.

Hopefully your payment provider will be able to help.

The seller has not scammed you. All items have a returns policy on so there could not previously have been nothing on the seller's items about returns.

 

It shows that you need to be careful and accurate when you start a return case.

The only time you can open two cases (not returns), is when you open one for item not received and then need to open one for item not as described when the item actually arrives.

 

You can't open a return case for a different reason after opening one for the wrong reason.

Once you close a case that's the end of it. It can't be reopened.

 

You may still be able to get a refund through your payment provider. If you paid by PayPal you may be able to use their 30 day buyer protection policy. If by credit or debit card, ask your card issuer whether they can help.

Sorry, I was updating my original reply, but the time I could get back to it it was too late.

 

The point is that if you didn't use the correct procedure, and the procedure you used allowed the seller to close the case, you can't blame eBay for not taking any responsibility - because they can't. The type of case you had opened entitled the seller close it if they had a no returns policy and eBay has to respect their rights, as well as yours. As I keep reminding buyers, eBay is not like buying from the shops.

 

I wish this could be a better news answer, but that's the way it is.

I wish I could show you the photos I have taken, because on the original listing, there was no mentiion of the word 'return' and when I started the return process all of a sudden the next photo shows 'no returns accepted.'

As I said I have photos of both before and after, so not sure how this is possibe?

I don't doubt that is what you think, but if you look at any listing on the site (and there are millions) they all have a returns policy on, to the right of the item, somewhere beneath the 'Add to watchlist' link.

As this photo shows, it is the original listing and does not the the word 'return' anywhere. When I tried to return the product (numerous scratches on both visors - so not in 'excellent condition' as advertised), I the wording changed to 'returns not accepted' and 'case closed' I have photos of these too  but cannot upload them as they are in microsoft word and it does'nt let me save them.

I am going through my bank.

The screenshot you have posted doesn't include the returns policy. On a PC this will be with other information to the right of the main photo. The seller's returns policy will be shown near the bottom, directly above "Payments". Not sure if the display on the app is different, but it will be there somewhere.

 

Or let us know the item number, which would be much more helpful. This is given on the right, nor far below the "Payments" information.

 

The seller will not have been able to change this policy after the listing ended.
