Scammed big time

I thought i was buying an iPhone 17 pro max but when I got my package it was an empty small brown padded envelope that wouldn't even hold an iPhone 17 never mind the box.  Seller asked me to close refund request and would issue the refund which I did but never received refund.  Contacted ebay but they can't do anything.  Have tried with bank and looks like I'm not getting anywhere with them.

The seller well and truly scammed you.  By closing the eBay case you cannot opened another for that item with eBay.

 

Opening a case for item not as described and escalating it would have enforced a refund.

 

Turn  now to your payment provider for help with your refund.

 

In future,  never listen to promises and excuses from a seller,  they cannot be enforced like an eBay case can,  and never close a case early.

Yeah have learnt that from speaking with ebay even though messages to the
seller the last message was saying that I won't get the phone but a very
expensive lesson learnt here.

Your payment provider should be able to help you,  it's too much money to wave goodbye to.

 

Contact them tomorrow.

Oh I have and raised a dispute but have now been told that they have
evidence to prove i recieved the item and they will take the money back
from me as they gave me a temp refund

Your claim should have been for receiving the wrong item, not that you didn't receive anything!

 

If a seller sends anything, even the wrong thing, with tracking, you cannot claim you didn’t receive anything as they can prove you did.

 

The claim has to be based on receiving the wrong thing.

That's what the bank said to me that they were claiming that I didn't
receive what I paid for.

You can claim based on:

 

1. You don't recognise the transaction, or,

2. you didn't receive anything or,

3. there is something wrong with what you received (in other words it was an envelope not a phone).

 

Which did you do?  Sellers have no defense against chargeback claims made under 3 above.
