Return item misdelivered by Royal Mail. How to claim?

Hi all,

 

I've got a bit of an odd one here.

 

I sold an item and the buyer opened a INAD case, I accepted the return and an eBay generated Royal Mail tracked returns label was sent.

 

Unfortunately the delivery was due while I was away on holiday and I wouldnt return before the two day time limit (the buyer refused to wait for me to return before issuing a refund.)

 

When the item tracking on eBay and RM showed as delivered I issued the refund.

 

I get back to no parcel. RM case is logged and turns out it was misdelivered to an address which wasn't on the label provided and cannot be retrieved (I suspect foul play on part of the buyer as their INAD was unfounded but of course can't prove anything)

 

So now I am without my item and down £130ish

 

RM have suggested that I make a claim for a lost item. Issue is I don't have the proof of postage as that was on the buyer (I did reach out to the buyer but they havent responded, surprisingly)

 

I asked RM about this and they suggested eBay would have to make the claim on my behalf as they generated the label ...when I asked an eBay rep about this they weren't too sure....

 

The eBay rep sent me a Packlink claim link but it doesn't seem to accept RM return tracking codes

 

Anyone have any idea? Can I claim at all and if so what is the correct way? I seem to get conflicting info from RM and eBay.

 Any help appreciated. I feel this is a lost cause but I'd like to try
