Reproduction Classic car Badge removed under counterfeit items policy

Hi, 

I sell classic car parts, have done for several years on eBay. last week one of my items was flagged under the counterfeit items policy.  It is a Volvo amazon front wing badge. A late 60's - 70's car. The '121' badge is no longer produced by Volvo, so the only way a person who wants a new one for their restoration is to buy a reproduction 'Bastuck' one, which is what i'm selling. But - really scarily for me - ebay says it's not allowed. Scary because they could apply this logic to about half of my listings, but it's just this 1 badge that has been singled out. 

I have appealed which has not been upheld, i just don't know what to do about it. The appeal rejection doesn't even give me any ideas of how to fix this, or how to word it or any help at all. I called and the lady i spoke to was no help either. This could affect my business exponentially, and my ability to continue with it, it just wouldn't pay if i can't sell new items that are made for replacement parts. Does anyone have any ideas or advice ?

Sounds to me that that it is  Volvo who have asked for removal as the Brand Owner, read this about VERO https://www.ebay.co.uk/help/selling/listings/creating-managing-listings/removed-hidden-listings?id=4...

I think it is most unlikely that ebay robots would have detected a fake, or removed because of the word “reproduction”.

I agree with john1297576 that Volvo must have reported it.

 

Brands are very protective of their rights to registered images. Sellers on eBay constantly infringe brand owners' copyright to cash in on the market for brand identity products.

 

eBay may have used the word counterfeit for simplicity. In fact, your item wasn't pretending to be an original, Volvo product, but copying and selling protected images is still a contravention of their copyright. In reality, I don't suppose Volvo would be too concerned about a vintage badge for restoration, but it was probably reported automatically.

Hi, 

i appreciate your replies, i was assured by customer services on eBay that Volvo hadn't reported it - thankfully, as most of my listings are for reproduction parts of very old cars which are no longer made by the original manufacturer.

I spoke to eBay again as my appeal wasn't upheld, I was on the phone for 30 minutes with a very knowledgeable guy who was really helpful but he had no idea why this item had been flagged.

Bastuck, who make these badges have been making them since 1986 and Volvo are fully aware they make and re manufacture many Volvo parts. 40,000 classic parts in fact.
