What happens when you receive an item as a fake? 

I've opened a returned case and reported the item but i feel somehow this should be treated a bit more urgent before the seller absconds.

Ebay allow you to return the item for a full refund.

What do you mean about the seller absconding?

If you want to take more action than Ebay allow (return/refund/feedback) you would have to contact Trading Standards or another official body.

However, generally nobody will take action on the word of one dissatisfied buyer.

So long as you opened the correct case, seller has to provide a reply paid label and on return refund in full.

If no response from seller then after 3 days you escalate to ebay who will force refund. Have you not noticed when you buy you pay ebay a fee to ensure you get what you paid for or a refund.
