Problem buyer

I have had a buyer buy 3 items from me, say they were in worse condition than expected and demand a refund saying they would post them back to me but they haven't and I can see they have got them for sale on their own eBay account. I have tried to report them to eBay with no success, is there anything else I can do and is it even a police matter as it is technically theft? I feel that ebay are not going to do anything and I have lost the items now.

the proper procedure was for the buyer to open a not as described case, you to supply a prepaid returns label and refund when you got the items back.

 

eBay won't get involved nor will the police.

Thanks... am absolutely gutted as first I got an email saying they wanted a
refund before I got an email about returning so I did the refund in a panic
as they were sending me fairly nasty messages complaining about the items
and I thought eBay held the funds til I got the items back, I think this is
a stunt this person pulls on a regular basis as there was nothing wrong
with the items but they made me feel awful and now they are trying to sell
them for more than double what I was advertising them at so there
definitely wasn't anything wrong with them!
