Pre order scam

I have pre ordered the new Zelda game a month in advance  & waited & should of came 26th last Month, I also note that there were 176 sold before me, I messaged the seller which has still not replied, they have also noticed they have removed all their listings, & tried to cancel the order but eBay said it was too late because it is on it's way ( it isn't it has never even marked been dispatched ) & I had to wait to 7th Oct to open a case I came on yesterday & eBay said it could still be on its way! Please wait & it not arrived by 8th to try again , just gone back on do report not arrived & it is still saying the to wait till 8th which it is,I am on an alos I did check the sellers sale reviews which were all reasonable & he had a lot of listed & a lot already sold before I purchased it, what is the best course of action now,

On exactly what date did you pay?

I purchased it on 19 august

eBay works in 24hr periods, so you may have to wait until the time you actually bought the item to be able to open a not received claim.

Try again in the morning.

Preorders have to sent within 40 days of listing. 

If ebay case is too late, try your payment provider. 

But you can't have 2 claims open at same time.
