Hi Dear Ebay Community,
I ordered 3 nail varnishes, and the seller has claimed they sent all 3 as multiple items tracked.
The tracked package was delivered, but only 2 nail varnishes not 3.
They had also put 2 receipts in the package ticking off the item as if they'd placed it in the pack.
I've tried to message the seller but no answer.
I've started a refund process for the missing nail varnish, but of course EBAY has said the package shows as delivered, please check your house/neighbours/post box etc.
I did say in my message to them I had the package, but not all of the order.
So it looks like I've received all the nail varnishes and I haven't.
I then decided to read the feed back and it seems the seller has done this frequently, but they are a massive seller as in 6k feedback, so if they do this 1% of all sales.... I guess it's a racket, frustrating and strangely has stressed me because it was the colour I wanted more than the other 2 (lol).
It's only £5.99, but it was a treat for me.
I hate theft, but proving it when they sent a tracked package is impossible.

You opened the wrong case.
Was this one purchase, and not 3 separate orders ? If you opened one for item not received, all the seller had to do was to enter a tracking number and it shows delivery, because an item was delivered, but not complete.
This is the only time when you can open another case for the same item, so proceed this way now.
You have received an item not as described, so you are guaranteed a full refund under eBay's 30 day MBG, Money Back Guarantee policy, if you claim within 30 days of the item's last estimated date for delivery.
You then go right of the item in your Purchase History, and from More Actions select Return this item, selecting the reason... Item Not as Described.
The seller has 3 days to accept the case, if they don't , you need to escalate on day 4, or within 30 days, and eBay will step in and force the refund.
If the seller wants the item back first, they need to pay for a fully tracked return postage. On receipt of their item they have 48 hours to refund you. Again, if they don't, you escalate the case.
Do not close the case early for any excuse or promise the seller may give, and do not forget to escalate.

I had bought 2 colours and that generated a separate order number.
Then went back, bought the other colour and that was a different order number and the one I've asked for a refund.
I bought them within minutes of each other.
They then did the all in one tracked package.
So, do I now go to the ones that did arrive and start the item not as described? even though I don't want to send them back please.

In these circumstances you will need to return the items you got in the order for 2 before getting a refund.

I don't want to return 2 when 3 were alledged posted but weren't, so I'd still lose the money as I'd only get a refund for 2? and then have no nail varnishes at all 🙂 and, I'd have to get someone to take them to the post office as taking me would be an absolute faff.
I shall continue to wait for Ebay and the date of 5 more days I think it was before I escalate it and see if they help me.
Crazy thing is, if it wasn't intentional this time from this seller then surely their stock would show that or they found it on the floor/still on the desk etc who knows really.
Again, back to feedback which I wish I'd read before, it seems they are frequent in not posting or selling out of stock and folks have given up with a refund etc
Never mind, I shall search for that colour else where 🙂

Thinking about it you could return 1 and get a refund for 2 that way you have 1 nail varnish that you have paid for, which is the right result.

who'd have though nail varnish could cause such angst 😅
I like the other 2 colours, I have indeed painted my nails now in one of the colours.
I feel I shall resign myself to a loss and mourn the bright pink varnish I shall never own 😅
